Am I Eligible for Social Security Disability?

Helping People Understand Social Security Disability Benefits

Social Security Disability (SSD) benefits are available to people who can’t work due to an impairment that is expected to last longer than one year or result in death. The Social Security Administration (SSA) follows strict guidelines to determine who is eligible for benefits and who is not.

If you think you may qualify for SSD benefits, call the Social Security Disability lawyers at Lundy Law. We understand the complex Social Security system, and we want to help you get the benefits you’re owed.

5 Steps of the SSD Evaluation Process

To determine if you are disabled, the SSA uses a step-by-step process that involves answering the following five questions:

  1. Are you working? As of 2012, if your earnings average more than $1,010 a month, you cannot be considered disabled.
  2. Is your condition “severe?”The SSA deems your condition “severe” if it interferes with basic work-related activities.
  3. Is your condition found in the list of disabling conditions? The SSA maintains a list of medical conditions that are so severe that they automatically qualify you as disabled. If your condition is on the list, you are automatically deemed disabled by the SSA. If it is not on the list, the SSA will take into consideration the answer to the next question.
  4. Can you do the work you did previously? The SSA will want to determine whether or not your condition interferes with your ability to do the work you did previously.
  5. Can you do any other type of work? The SSA will want to determine if there is another line of work you can do, taking into consideration your age, education, past work experience, and transferable skills.

If you have questions about whether or not you are eligible for SSD, the Social Security Disability attorneys at Lundy Law are here to help.
