Car accident victim receives $6 million settlement in New Jersey lawsuit against school district

The Asbury Park Press reported that a New Jersey student won a $6 million settlement in a law suit after being paralyzed in a car accident. The student was injured in a New Jersey auto accident in 2001 after being dismissed early from school. The lawsuit claimed the school is responsible for students when they are dismissed early.

The lawsuit argued that the school didn’t give any notice to families of the early dismissal from school before the car accident victim was hit. He was in elementary school at the time of the accident, and ran out into the street after being dismissed and was hit by a car.

Wyeth ordered to pay over $120 million in drug case

October 12, 2007

Pharmaceutical giant Wyeth was found guilty of negligence in producing, marketing, and selling two hormone-replacement drugs, Prempro and Premarin, according to the Reno Gazette-Journal.

Wyeth was ordered to pay more than $43 million to each of the three women whose lawsuit claimed they developed breast cancer after using the dangerous drugs.

The jury will decide Friday whether or not Wyeth should pay punitive damages as well, as they could cause serious dangerous drug injuries in others. The pharmaceutical company is involved in about 5,300 similar lawsuits in state and federal courts across the nation with close to 7,800 women.

Several New Jersey motorcycle accidents related to biker event

October 9, 2007

Alcohol and vanity motorcycle helmets may have contributed to New Jersey motorcycle accidents involving patrons coming from an Oktoberfest biker event, according to the Asbury Park Press. The motorcycle accidents in Jackson, Lakehurst, and a fatal collision in Freehold all involved patrons leaving the event at Just Plain Janes on Route 528 Sunday afternoon.

The Freehold motorcycle accident victim died when he was struck by a drunk driver who was unconnected with the event, and police don’t yet know if the motorcyclist was under the influence.

There were also two New Jersey motorcycle accidents in Jackson, one of which involved one car and three motorcycles and happened in the identical place where three teens were killed several weeks ago on East Veteran’s Highway.

Young Pennsylvania brain injury victims to participate in national clinical trial

October 5, 2007

News-Medical.Net reported that the Children’s Hospital of Pittsburgh will lead a clinical trial to examine a therapy for children with brain injuries. The report states that, “[t]he trial will test the effectiveness of induced hypothermia as a therapy for brain swelling in children who have suffered .”

$11.5 million is being invested into the clinical trial and has been awarded to 12 centers across the country for participating in the five-year trial. A total of 340 children up to the age of 16 who have suffered brain injuries, birth and child injuries, or other personal injuries due to blunt trauma, are expected to be enrolled. The National Institute of Neurological Disorders and Stroke, a component of the National Institutes of Health, is funding the project.

Pennsylvania workers’ compensation under-budgeted in nursing homes

Under-budgeting in nursing homes has left several out in the cold on Pennsylvania workers’ compensation benefits, according to The Morning Call. For several years, Schuylkill County’s nursing home has underfunded workers’ compensation benefits, putting a strain on other departments’ contributions to fill the void.

Just $256,000 was budgeted by the county administrator’s office for workers’ compensation in the coming year. More than $500,000 has been paid this year with three months to go and more cases pending.
